Terms of use

These terms are an agreement between you and Gurpal Bagdi, a sole trader trading as Gurpow Studio (business address [BUSINESS ADDRESS]), about playing Wingshot. "We" and "us" mean Gurpal trading as Gurpow Studio. By playing, you accept them. If you don't, please don't play. Contact us at hello@gurpow.com.

Our privacy policy explains how we use your information.

1. Who can play

Wingshot is for players aged 13 and over. If you are under 18, you need a parent or guardian's permission before buying anything.

2. Your licence

We give you a personal, non-transferable licence to play Wingshot on your own devices for fun, not for commercial use. We own the game, its art, music and characters. You must not copy, sell or modify the game, cheat, use bots, hack or exploit bugs, or interfere with other players or our systems, except where the law allows you to.

3. Coins, theme points and items

Coins, theme points, weapons, upgrades, cosmetics and other in-game items are part of the game. They have no real-world value, can't be exchanged for money, and can't be sold or transferred. You have a licence to use them in the game; you don't own them. Theme points can only be earned by playing and are never sold.

Purchases are cosmetic or save time. Everything that affects play can also be earned by playing, and paying never gives a gameplay advantage.

Your progress is saved on your phone. If you uninstall the game, clear its data or reset your progress, it is lost and we can't restore it. Coin packs are added once and can't be restored after your save is deleted. The Ad Pass is linked to your Google account, so Restore purchases in Settings brings it back.

We may rebalance the game, for example changing prices in coins, weapon strength or rewards, to keep it fair and fun.

4. Buying coin packs and the Ad Pass

Purchases are made through Google Play, and Google Play's terms of service also apply. Prices are shown in the coin shop and in Google Play, in pounds for UK players, and include any VAT. The coin shop says what each purchase includes before you buy.

A coin pack adds its coins to your save once, straight away. The Ad Pass is a one-off payment: while you have it, each reward you would get by watching a rewarded ad is given without the ad. It keeps the same daily limits as watching ads, so it never gives more coins, tries or revives than a player who watches them, and it doesn't stop ads that aren't rewarded if we ever add any. It lasts for as long as we offer Wingshot (see section 8).

Under the Consumer Contracts Regulations 2013 you normally have 14 days to cancel a purchase of digital content. Before you buy, the coin shop asks you to agree that your purchase is delivered straight away and that you then lose this right to cancel.

Under the Consumer Rights Act 2015, what you buy must be as described, fit for purpose and of satisfactory quality. If it isn't, contact us and we'll fix or replace it, or give you a refund or a partial refund. You can also ask Google Play for a refund under its refund policy.

5. Ads

Rewarded ads are optional. Ads are provided by Google AdMob, and we aren't responsible for advertisers' products or websites. A reward is given once the ad finishes; closing it early gives no reward. If no ad is available, we may give the reward anyway, but we don't have to.

6. Online leaderboards and friends

Joining the online leaderboards is optional. Your pilot name is made up for you from a list of words; the first new name is free and later ones cost in-game coins. Friends add each other by code, and you can remove or block anyone. There is no chat.

Results are checked automatically, and Daily Challenge results can be replayed to make sure they were really played. We may keep any result off the boards, remove it, change a pilot name, or remove a profile from the boards if we reasonably believe it breaks these terms, for example through cheating, bots, modified apps or exploiting bugs. Places on a board are for fun and win nothing unless a competition's own rules say so.

You can delete your online profile at any time in the game or at wingshot.app/delete. Your coins and items stay on your phone either way.

7. Competitions and cash prizes (coming later)

We may run competitions with cash prizes. When we do:

• Entry is always free. You never have to pay or buy anything to enter or to win, and purchases give no advantage.
• Only UK residents aged 18 or over can win. We will ask for proof of age, identity and address before paying a prize.
• Prizes are fixed amounts, announced in advance, and won by skill (for example, the top scores on a leaderboard), not by chance.
• We check scores for cheating, and we may disqualify anyone who cheats, uses bots or modified apps, or breaks these terms, and take back any prize won that way.
• Each competition will have its own rules, published in the game before it starts, which will apply alongside these terms. [Have competition rules checked against the CAP Code (section 8) before the first competition.]

8. Changes and availability

We may update the game, add or remove features, or change these terms. If a change matters to you, we'll tell you in the game, and if you keep playing after that you accept the new terms. We aim to keep Wingshot available, but we can't promise it will always work without interruption. If the business becomes a limited company, it will take over these terms and we'll tell you in the game. If we ever close the game, we'll give at least 30 days' notice in the game and stop selling purchases first.

9. Ending your use

You can stop playing and uninstall the game at any time. If you seriously break these terms, for example by cheating in a competition, we may stop you taking part in competitions or online features, including the leaderboards.

10. Our responsibility to you

If we fail to follow these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for loss that isn't foreseeable, or for business losses, because the game is for personal use. If faulty digital content we supply damages your device or other digital content, and that's because we didn't use reasonable care and skill, we'll repair the damage or pay you compensation. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law doesn't allow us to limit, and nothing affects your legal rights as a consumer.

11. The law that applies

These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring them in your local courts.
